Highway 79 near Prague, Nebraska

Laurie Richards, Nebraska Film Officer from the Nebraska Film Office, gave permission for us to use the images of downtown Omaha and Highway 79 near Prague, Nebraska. Each of these images are pictured below and are featured on both our Flash and HTML websites. We found these fantastic pictures of Nebraska on the Film Nebraska website.   Richard C. Moeur: Road Signs

Mr. Moeur's Traffic Signs

  Freemidi Website: Road Songs

We attempted to get permission from http://www.freemidi.org/ to use the following MIDI songs downloaded from their website:
  • King of the Road;
  • Hit the Road Jack;
  • Country Road (John Denver version);
  • Six Days on the Road;
  • Country Road (James Taylor version);
  • Murder on Music Road;
  • The Long and Winding Road;
  • Every Day is a Winding Road;
  • Goodbye Yellow Brick Road.
As you can tell from “listening” to the Enhanced version of our website, these MIDI songs are not original works published by a recording artist, but rather electronic, computer-generated works freely available on the website.

Unfortunately, we were unable to get a response to our request for permission. Consequently, we evaluated the usage of this work according to the “fair use” guidelines published on the Stanford Copyright and Fair Use website. We believe we are justified in using these songs based on the four factors judges consider related to fair use, as described below:
  1. The Transformative Factor: The purpose and character of your use According to Stanford, “Purposes such as scholarship, research or education may also qualify as transformative uses because the work is the subject of review or commentary.” Our website is for educational purposes, and therefore passes the first test of “fair use.”
  2. The Nature of the Copyrighted Work We do not believe this work to be copyrighted. There is no copyright information on the Freemidi website.
  3. The Amount and Substantiality of the Portion Taken According to Stanford, “The less you take, the more likely that your copying will be excused as a fair use.” For that reason, we took a small portion of each song rather than the entire work.
  4. The Effect of the Use Upon the Potential Market According to Stanford, “Another important fair use factor is whether your use deprives the copyright owner of income or undermines a new or potential market for the copyrighted work.” Since the Freemidi website does not charge users to download the songs, there is not an economic disadvantage to the owner.
We believe we are well within the guidelines outlined by Stanford to legally use the songs we obtained from Freemidi. We also notified the website that we planned to use the songs and that they should let us know if they disapproved of this use. If we hear from Freemidi that they prefer us not to use the song selections, we will remove them from the website.

 
 
 
  Microsoft: Clip Art

Within the websites, we used various clip art files from Microsoft. Given we have a licensed copy of Microsoft Office, Microsoft grants permission for "Personal and Non-Commercial Use" of this clipart to licensed users.
 
   
  Zero2000.com: 2nd Speech Center

2nd Speech Center

Thanks to the folks from Zero2000.com who gave us a free copy of 2nd Speech Center. It's a cool tool that can "read" text and create mp3 files. We used it to create the narration on our Enhanced version. Visit 2nd Speech Center website to find out more. We highly recommend this easy-to-use, functional tool.
